Lan Signer End User License Agreement and Terms of Service

1. These terms

These terms govern the Lan Signer app ("Lan Signer") between you and Loheden AI Solutions AB ("we"). By downloading or using Lan Signer you accept them. If you accept them for a business, you confirm that you may bind it. Our privacy policy describes how we process personal data; it is not part of these terms.

2. Summaries, suggestions and signatures

Lan Signer's summaries and form suggestions are produced automatically and may be wrong, incomplete or unsuitable. Review them against the document before you rely on them, and never use them as the only basis for a decision about health, law or money. Lan Signer does not give legal or other professional advice. We do not verify who signs, and we make no promise that a signature or a document made with Lan Signer is valid, enforceable or accepted for any purpose; you decide whether an electronic signature suits your document, and you follow the law that applies to it. Adding a signature or text changes the PDF, and a recipient or system may not accept the result.

3. Licence and use

We give you a personal, non-transferable licence to use Lan Signer on Apple devices you own or control, for your own non-commercial use, under these terms and the App Store's rules. You may not copy, resell, sublicense or share it, get around a purchase or a limit, use it unlawfully or to harm others, such as to forge a signature or a document or to sign without authority, or reverse engineer it except where the law allows that.

4. Your documents and your device

Your documents, signatures, summaries and profile details are kept on your device and, if you turn on backup, in your own iCloud account. We do not hold a copy of them and cannot recover them, so keep your own backups. You answer for the security of your device and for what you sign and send.

5. Purchases

Some features need a subscription or a one-time purchase. Purchases, renewals, cancellations and refunds are handled by Apple through the App Store, under its rules. A subscription renews until you cancel it in your App Store account; deleting the app does not cancel it.

6. Changes to Lan Signer

We may change, suspend or discontinue Lan Signer or any part of it. Towards a consumer we do so only for a valid reason, such as a legal, security, technical or commercial one.

7. Ending access

We may suspend or end your access at once if you break these terms or the law, commit fraud, reverse a payment, become subject to sanctions, or where the law requires it, with no refund beyond what the law gives.

8. No warranty

TO THE FULLEST EXTENT THE LAW ALLOWS, LAN SIGNER IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AVAILABILITY AND NON-INFRINGEMENT.

9. Liability

As far as the law allows, we are not liable for indirect or consequential loss, lost profit, revenue, business, goodwill or data, or loss caused by others, and our total liability is limited to, for a subscription, one month's worth of your latest payment for Lan Signer (that payment scaled to one month of the period it paid for, so a twelfth of a yearly one), and for a one-time purchase, what you paid for it, but no more than USD 100 or the same value in the currency you paid in. If you use Lan Signer as a private person, we are not liable for any loss in a business activity. This does not limit liability that the law does not allow us to limit.

10. Indemnity

A business customer indemnifies us against claims, losses and costs arising from its use of Lan Signer in breach of these terms or the law.

11. Time to claim

A business customer must bring any claim within one year of when it knew or should have known of it.

12. Sanctions and age

You confirm that you are 18 or older, that you are not subject to EU, UN, US or Swedish sanctions, and that you are not in a place under a comprehensive embargo.

13. Changes to these terms

We may change these terms. A one-time purchase keeps the version accepted; a new version covers new purchases. For a subscription we tell you in the app or on this page before a renewal to which a new version applies, and you may cancel before it does. For a business customer, a new version otherwise applies from the date it gives.

14. Law and courts

These terms are governed by Swedish law, without its conflict-of-law rules and excluding the UN Convention on Contracts for the International Sale of Goods. A consumer keeps the protection of the mandatory rules of the country where they live. Any dispute with a business, or with a consumer living outside the EU, the EEA, Switzerland and the United Kingdom, is settled exclusively by the Swedish courts, with the district court for our registered office as the first instance. Outside the EU, the EEA, Switzerland and the United Kingdom, claims may be brought only individually, not as a plaintiff or class member in a class or representative action, and any jury trial is waived.

15. General

If a clause is invalid, the rest stands. These terms are the whole agreement about Lan Signer. We may transfer our rights and obligations to a company that takes over Lan Signer. We are not liable for delay or failure caused by events beyond our reasonable control. We may give notice in the app or on this page. We may use any feedback you give us for any purpose, without obligation to you. If a translation differs from the English, the English prevails for business customers.

16. App Store

These apply in addition to the terms above if you got Lan Signer from the App Store.

• These terms are between you and Loheden AI Solutions AB only, not Apple, and we, not Apple, are solely responsible for Lan Signer and its content.
• Your licence is to use Lan Signer on Apple-branded products you own or control, as the Usage Rules in the Apple Media Services Terms and Conditions permit; other accounts linked to you may use it through Family Sharing or volume purchasing where applicable.
• We are solely responsible for any maintenance and support of Lan Signer, as these terms or the law require; Apple has no obligation to provide any.
• We are solely responsible for any product warranty, express or implied by law, to the extent not effectively disclaimed. If Lan Signer fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, for Lan Signer. As far as the law allows, Apple has no other warranty obligation, and any other claims, losses, liabilities, damages, costs or expenses from a failure to conform to a warranty are our responsibility.
• We, not Apple, are responsible for addressing any claim by you or a third party about Lan Signer or your possession or use of it, including product liability claims, claims that it fails to conform to a legal or regulatory requirement, and claims under consumer protection, privacy or similar law.
• If a third party claims that Lan Signer or your possession or use of it infringes its intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling and discharging that claim.
• You confirm that you are not in a country subject to a US Government embargo or designated by the US Government as a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties.
• Questions and complaints about Lan Signer go to Loheden AI Solutions AB at the contact details below.
• You must follow any third-party terms that apply when you use Lan Signer, such as your mobile data agreement.
• Apple and its subsidiaries are third-party beneficiaries of these terms, and once you accept them Apple may enforce them against you as a third-party beneficiary.
